Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of PicoClaw, a service provided by Usto AI ("we," "us," "our"). By creating an account or using our service, you agree to these Terms. If you do not agree, do not use PicoClaw.

2. Service Description

PicoClaw is a platform that allows you to deploy and manage AI-powered chatbots on messaging platforms including Telegram and Discord. We provide the hosting infrastructure, deployment tools, and management dashboard. You provide your own LLM provider API keys and messaging platform bot tokens.

3. Account

  • You must be at least 13 years old to use PicoClaw.
  • You are responsible for maintaining the security of your account.
  • You must provide accurate information when creating your account.
  • One person or entity may not maintain more than one account.
  • You are responsible for all activity that occurs under your account.

4. Subscriptions & Payments

Free Trial

New users may receive a free 3-day trial with limited features. At the end of the trial, your bot will be stopped unless you subscribe to a paid plan.

Paid Plans

Paid subscriptions are billed monthly or annually via Stripe. Prices are listed on our website and may change with 30 days' notice to existing subscribers.

Upgrades

When upgrading mid-cycle, you will be charged a prorated amount for the remainder of the current billing period. The new plan takes effect immediately.

Cancellation

You may cancel your subscription at any time through the billing portal. Your plan remains active until the end of the current billing period. No refunds are issued for partial periods.

Failed Payments

If a payment fails, we will attempt to collect payment per Stripe's retry schedule. If payment is not received, your subscription may be suspended and your bots stopped.

5. Your Responsibilities

You agree to:

  • Comply with the terms of service of any LLM provider whose API keys you use (e.g., Anthropic, OpenAI, Google).
  • Comply with the terms of service of any messaging platform your bot operates on (e.g., Telegram, Discord).
  • Not use the service for any illegal purposes.
  • Not use bots to send spam, harass users, or distribute harmful content.
  • Not attempt to circumvent usage limits or plan restrictions.
  • Not reverse-engineer, exploit, or attack our infrastructure.
  • Keep your API keys and bot tokens secure. We encrypt them at rest but you are responsible for not sharing them.

6. Prohibited Uses

You may not use PicoClaw to:

  • Generate or distribute illegal content
  • Impersonate other people or organizations
  • Conduct phishing, scams, or fraud
  • Distribute malware or engage in hacking
  • Violate the intellectual property rights of others
  • Operate bots that violate Telegram or Discord terms of service
  • Mine cryptocurrency or run workloads unrelated to chatbot operation

We reserve the right to suspend or terminate accounts that violate these terms without refund.

7. Service Availability

We strive for high availability but do not guarantee uninterrupted service. The platform may experience downtime for maintenance, updates, or unforeseen issues. We provide automatic health monitoring and bot restarts as part of the service.

We are not liable for downtime or data loss caused by third-party providers (Hetzner, Stripe, LLM providers, messaging platforms).

8. Data & Privacy

Your use of PicoClaw is also governed by our Privacy Policy. By using the service, you consent to the collection and use of data as described in that policy.

9. Intellectual Property

You retain ownership of your bot configurations, system prompts, and content. We retain ownership of the PicoClaw platform, brand, software, and infrastructure. The bot configurations you create are yours and will be deleted upon account deletion at your request.

10. Limitation of Liability

To the maximum extent permitted by law, Usto AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the service.

Our total liability for any claim related to the service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the service will be error-free, secure, or available at all times. We do not control or take responsibility for the output generated by LLM providers through your bots.

12. Account Termination

You may delete your account at any time from the billing page. Upon deletion, all your data, bot configurations, and deployed bots will be permanently destroyed.

We may suspend or terminate your account if you violate these Terms, with or without notice. In case of termination for cause, no refund will be issued.

13. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes via email at least 30 days before they take effect. Continued use of the service after changes constitutes acceptance.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law provisions.
